Terms of Service
Last updated: September 15, 2026
1. General provisions
1.1. By using Deployka (the "Service"), you accept these terms. If you disagree, do not use the Service.
1.2. The Service provides managed container hosting for Telegram bots, APIs, and small applications. The pricing page and checkout define which plans and features are currently available.
1.3. You remain solely responsible for your content complying with the laws of your jurisdiction.
1.4. Deployka is the Service trading name. Buyer contacts, delivery information, and merchant disclosures are published on the Contact page.
1.5. By creating an account or making a purchase, you confirm that you are old enough to enter into this agreement under the laws of your country.
1.6. Plans and service scope
Free Nano is free: 128 MB RAM, one project, a queue when the pool is full, and term and idle limits shown before launch. Nano Reliability includes 256 MB RAM, a persistent slot without Free TTL/idle reclaim, automatic restart, and crash/recovery alerts. The price, term, and any available offer are shown in your selected currency before payment.
The price and charge currency are always shown before payment. For a converted payment in another currency, the provider checkout additionally shows the exact payable amount and charge currency.
2. Acceptable Use Policy (AUP) — Prohibited uses
2.1. It is strictly prohibited to use the Service for:
- Crypto mining, farming, plotting — immediate suspension without warning
- DDoS attacks of any kind and botnet participation
- Spam distribution (email, Telegram, SMS, or any other channel)
- Hosting or distributing malware, ransomware, or viruses
- Phishing, scams, or fraudulent schemes
- Hosting pornographic or sexually explicit content
- Trading weapons, drugs, or fake documents
- Copyright infringement (torrents, pirated content, warez)
- Open proxies for bypassing restrictions
- Tor exit nodes
3. Suspension and warning system
3.1. Immediate suspension (no warning): mining, DDoS, malware, phishing, scams. The server is suspended instantly and the account is frozen.
3.2. Warning + 24 hours to fix: spam, torrents, open proxies, copyright infringement. If unresolved, the server is suspended.
3.3. Warning + 72 hours: minor violations (unexplained high CPU load, suspicious traffic).
3.4. After a server is suspended, you have 7 days to open a support ticket to clarify the circumstances.
3.5. A repeat violation results in a permanent account ban with no refund.
4. Monitoring and automated checks
4.1. Deployka uses automated monitoring systems to detect AUP violations.
4.2. The system tracks container CPU and memory usage (mining is suspected on sustained high CPU). We do not inspect the contents of your network traffic.
4.3. All data is collected automatically and used only to detect violations. We don't monitor the content of your applications.
5. Payment and billing
5.1. Before payment, the Service shows the selected plan or package, total amount, currency, service term, and payment method. A payment may activate a specific prepaid service period or add funds to the internal balance.
5.2. For balance-funded plans, the charge occurs on the monthly anniversary of purchase, in advance for the next month. If a month has no matching date, the charge moves to the last day of that month. Deployka does not debit an external payment provider without a payment confirmed by the user.
5.3. A fixed payment-provider package activates Nano for the service term shown at checkout (for example, 30 or 150 days) and is not a general-purpose balance top-up. Exact package terms are displayed before payment.
5.4. A paid project may be suspended when the balance is insufficient. It resumes automatically after sufficient funding unless a separate security or AUP suspension applies.
5.5. A project suspended for insufficient balance is not automatically deleted and retains its data until funding or manual deletion. Free Nano has separate limits: a project may be stopped after 7 days without activity or after 30 days, with advance notice under the current policy.
5.6. Refunds and correction of erroneous charges are governed by applicable law and our Refund Policy.
5.7. Taxes and provider fees, where applicable, are shown by the payment provider before confirmation. By selecting the payment action, you accept these Terms and the Refund Policy.
5.8. Paddle top-ups provide prepaid Deployka usage credits. The balance is used only for automated Deployka services and is displayed in the currency selected for the interface. It is not a monetary account: transfers to other users, cash withdrawals, and exchanges for money are not supported. The credit amount and pack price are fixed before payment; applicable refunds are processed through the original payment provider under the Refund Policy.
6. Liability and warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". DEPLOYKA MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Deployka does not guarantee uninterrupted operation, error-free performance, protection from breaches, or data integrity. Any uptime figures are informational and not a guarantee.
DEPLOYKA IS NOT LIABLE UNDER ANY CIRCUMSTANCES FOR:
- Any direct, indirect, incidental, punitive, or consequential damages
- Lost profits, data loss, or reputational harm
- Actions of third parties, hacking, or breaches
- The behavior of your application, code, bot, or site
- Actions of infrastructure partners
- Server seizures by government authorities or providers
- Harm caused to third parties by your content
- Your violation of law or the AUP
6.4. Where Deployka's liability cannot be excluded by law, it is LIMITED TO THE AMOUNT YOU ACTUALLY PAID IN THE PRECEDING 30 (THIRTY) DAYS.
6.5. This section survives termination of your use of the Service.
7. Indemnification
7.1. You agree to indemnify Deployka, its officers, employees, and agents against any liability, claims, damages, and expenses, including reasonable attorney fees, arising from:
- Your use of the Service
- Your breach of these terms or the AUP
- Your infringement of third-party rights or the law
- Your content, code, applications, or bots
- The actions of your users or customers
7.2. In plain terms: if someone sues Deployka over your actions, you cover the costs.
8. Privacy and data
8.1. We do not sell personal data. The necessary minimum may be shared with infrastructure, payment, authentication, and diagnostics providers, and with government authorities upon lawful request, as described in the Privacy Policy.
8.2. We don't inspect the contents of your servers without your consent. Exceptions are automated AUP checks and AI features that you explicitly start and to which you submit a message or project files.
8.3. Technical logs are retained for the operationally necessary period. You are responsible for safeguarding your API keys and passwords.
8.4. If your application collects personal data from its users, you are responsible for that processing and must have the required lawful basis, privacy notice, and access controls. Deployka provides infrastructure and processes that data only to the extent needed to operate the deployed project.
9. Termination
9.1. You may request account deletion through support. Projects are deleted after the request is confirmed; payment and legal records may be retained for periods required by applicable law.
9.2. Deployka may suspend or terminate service at any time without explanation. In that case, we refund the unused prorated balance.
9.3. Balances are not refunded if suspended for an AUP violation or at an infrastructure partner's request.
9.4. Deployka is not liable for damages related to service termination.
10. Infrastructure partners
10.1. Deployka operates the managed service and provides access to third-party infrastructure. Customer containers, builds, and persistent volumes are currently hosted on netcup GmbH worker infrastructure in the European Economic Area. The dashboard and separate system components may be hosted separately; backups may be transferred to other disclosed providers. Deployka does not own netcup data centers.
10.2. The user acknowledges and agrees that:
- Their servers are physically hosted at infrastructure partners' facilities, including netcup GmbH
- Deployka does not control and is not responsible for partners' infrastructure
- Infrastructure partners' own terms may apply to the user
- Deployka is not obligated to notify users of changes to partners' policies
- Infrastructure-related claims must be directed to Deployka, not partners directly
10.3. Deployka reserves the right to change infrastructure partners without prior notice.
11. Usage restrictions
11.1. You may not use the Service for any purpose prohibited by the AUP (section 2).
11.2. Deployka may block content or accounts without prior notice upon reasonable suspicion of an AUP violation.
11.3. Deployka's suspension decisions are final and not subject to review, except in cases of clear error.
11.4. Suspensions can be appealed through support within 7 days.
12. Force majeure
12.1. Deployka is not liable for failure to perform due to force majeure: natural disasters, war, terrorism, strikes, government decisions, internet or power outages, or actions of infrastructure partners.
13. Changes to these terms
13.1. Deployka may update these terms at any time. Continuing to use the Service after changes are published constitutes acceptance of the new version.
13.2. If you disagree with the changes, stop using the Service and delete your account.
14. Final provisions
14.1. If any provision of these terms is found invalid, the remaining provisions remain in effect.
14.2. Deployka's failure to exercise a right does not constitute a waiver of that right.
14.3. These terms are governed by applicable law. All disputes are subject to pre-trial resolution procedures.
15. Support and complaints
15.1. Support contacts: support@deployka.dev and Telegram bot @deploykabot.
15.2. Include the account email, project, payment date and ID, problem description, and requested resolution. Response targets are published on the Contact page.
